INTERNATIONAL COURT OF JUSTICE YEAR 2024 2024 26 January General List No. 192 26 January 2024 APPLICATION OF THE CONVENTION ON THE PREVENTION AND PUNISHMENT OF THE CRIME OF GENOCIDE IN THE GAZA STRIP(SOUTH AFRICA v. ISRAEL) REQUEST FOR THE INDICATION OF PROVISIONAL MEASURES
22. The Applicant further submits that at least some, if not all, of the acts committed by Israel in Gaza, in the wake of the attack of 7 October 2023, fall within the provisions of the Genocide Convention. It alleges that, in contravention of Article I of the Convention, Israel “has perpetrated and is perpetrating genocidal acts identified in Article II” of the Convention and that “Israel, its officials and/or agents, have acted with the intent to destroy Palestinians in Gaza, part of a protected group under the Genocide Convention”. The acts in question, according to South Africa, include killing Palestinians in Gaza, causing them serious bodily and mental harm, inflicting on them conditions of life calculated to bring about their physical destruction, and the forcible displacement of people in Gaza. South Africa further alleges that Israel “has . . . failed to prevent or to punish: genocide, conspiracy to commit genocide, direct and public incitement to genocide, attempted genocide and complicity in genocide, contrary to Articles III and IV of the Genocide Convention”.
30. At the present stage of the proceedings, the Court is not required to ascertain whether any violations of Israel’s obligations under the Genocide Convention have occurred. Such a finding could be made by the Court only at the stage of the examination of the merits of the present case. As already noted (see paragraph 20 above), at the stage of making an order on a request for the indication of provisional measures, the Court’s task is to establish whether the acts and omissions complained of by the applicant appear to be capable of falling within the provisions of the Genocide Convention (cf. Allegations of Genocide under the Convention on the Prevention and Punishment of the Crime of Genocide (Ukraine v. Russian Federation), Provisional Measures, Order of 16 March 2022, I.C.J. Reports 2022 (I), p. 222, para. 43). In the Court’s view, at least some of the acts and omissions alleged by South Africa to have been committed by Israel in Gaza appear to be capable of falling within the provisions of the Convention.
54. In the Court’s view, the facts and circumstances mentioned above are sufficient to conclude that at least some of the rights claimed by South Africa and for which it is seeking protection are plausible. This is the case with respect to the right of the Palestinians in Gaza to be protected from acts of genocide and related prohibited acts identified in Article III, and the right of South Africa to seek Israel’s compliance with the latter’s obligations under the Convention.
78. The Court considers that, with regard to the situation described above, Israel must, in accordance with its obligations under the Genocide Convention, in relation to Palestinians in Gaza, take all measures within its power to prevent the commission of all acts within the scope of Article II of this Convention, in particular: (a) killing members of the group; (b) causing serious bodily or mental harm to members of the group; (c) deliberately inflicting on the group conditions of life calculated to bring about its physical destruction in whole or in part; and (d) imposing measures intended to prevent births within the group. The Court recalls that these acts fall within the scope of Article II of the Convention when they are committed with the intent to destroy in whole or in part a group as such (see paragraph 44 above). The Court further considers that Israel must ensure with immediate effect that its military forces do not commit any of the above-described acts. 79. The Court is also of the view that Israel must take all measures within its power to prevent and punish the direct and public incitement to commit genocide in relation to members of the Palestinian group in the Gaza Strip. 80. The Court further considers that Israel must take immediate and effective measures to enable the provision of urgently needed basic services and humanitarian assistance to address the adverse conditions of life faced by Palestinians in the Gaza Strip. 81. Israel must also take effective measures to prevent the destruction and ensure the preservation of evidence related to allegations of acts within the scope of Article II and Article III of the Genocide Convention against members of the Palestinian group in the Gaza Strip. 82. Regarding the provisional measure requested by South Africa that Israel must submit a report to the Court on all measures taken to give effect to its Order, the Court recalls that it has the power, reflected in Article 78 of the Rules of Court, to request the parties to provide information on any matter connected with the implementation of any provisional measures it has indicated. In view of the specific provisional measures it has decided to indicate, the Court considers that Israel must submit a report to the Court on all measures taken to give effect to this Order within one month, as from the date of this Order. The report so provided shall then be communicated to South Africa, which shall be given the opportunity to submit to the Court its comments thereon.
78. در واقع شغل شما تو رشته روابط بین الملل ایجاب میکنه که 1). بتونید فایل اصلی حکم را پیدا و دانلود کنید و بخونید. 2). بتونید مستقل از مزخرفات رسانه ها خودتون بفهمید که معنیش در عمل چی میشه. الآن تو متن مطلقا جایی حرفی از آتش بس یا خارج شدن از غزه نیامده! دادگاه گفته اسرائیل باید مواظب باشه خدایی نکرده آنچه در کنوانسیون مصادیق نسل کشی معرفی شده دیگه از این به بعد اتقاق نیافته و کمکهای مورد نیاز به مردم غزه برسه اگر هم جرمی توسط سربازهاش اتفاق افتاده مواظب باشه شواهد و مدارکش از بین نره و هرکس جرمی مرتکب شده را هم خودش مجازات کنه و ظرف یک ماه گزارش بده!!! در ضمن گفته به شدت نگران سرونشت کسانی هست که حماس 8 اکتبر گرفته و حماس باید بلافاصله و بدون هیچ قید و شرطی هر کس را 8 اکتبر 2023 گرفته و نگهداشته آزاد کنه کاری به آزاد شدن یا نشدن کسانی که اسرائیل قبل و بعد از 7 اکتبر گرفته گرفته هم نداشته باشه!!!! تاز همه را هم مقامات اسرائیل گفتند مایه ننگ هست و مزخرفه. در واقع حتی این که نسل کشی انجام شده یا نشده را هم هنوز در موردش حکمی نداده گفته آفریقای جنوب حق داشته از اسراییل شکایت کنه و به نظر میرسه آنچه در شکایت آفریقای جنوبی اومده خیلی هم بیراه هم نیست اما فعلا ما نمیتونیم بگیم نسل کشی بوده یا نبوده!!! البته احتمالا 10 سال دیگه در مورد این که نسل کشی بوده یا نبوده هم نظر میده!!! گامبیا چهار سال پیش یعنی سال 2019 یه شکایت مشابه از نسل کشی مسلمانها توسط میانمار کرده که هنوز ICJ داره سرش جلسه تشیل میده و چرت میزنه!!! از سرفصلهای جدید دوره های ارشد و دکتری رشته روابط و همینطور ارشد دیپلماسی بالاخره رسما پرده برداری شد (البته از مهرماه 1402 اجرا شدند). ظاهرش ساده به نظر میاد اما آخرین بار این کار قبل از پایان جنگ سرد با موفقیت انجام شده بود (یعنی تا دو ترم قبل مثلا هنوز سیاست خارجی اتحاد جماهیر شوروی هم داشتیم!). نه این که بقیه ها سعی نکرده بودند در واقع زمان هر مدیر گروهی یک بار این کار شروع و بی نتیجه رها شده بود. دکتر قاسمی و دکتر نوروزی دو سال هر روز هفته پیگیری کردند جلسه رفتند و دفاع کردند تا به رغم تمام کارشکنی ها شد. (البته طبق معمول تمام فیلمها سه تا شخصیت منفی هم داشتیم که عملا هر کاری بلد بودند کردند که این کار هیچوقت به نتیجه نرسه!) به هر حال اصل کار خود دانشجوها هستند که باید بخوان همه درس ها را جدی بگیرند...
